Georgia’s Senate-approved proposal to ban THC from all hemp products stalled in the House Regulated Industries Committee after the committee chair said he was reluctant to ban a plant “that God lets grow naturally.”

In Georgia, hemp-derived products that comply with the 2018 Farm Bill and state regulations are legal. This means that hemp products must contain no more than 0.3% Delta-9 THC on a dry-weight basis. Here's a breakdown of what's legal in Georgia:

Legal Hemp Products in Georgia

  1. CBD Products (oils, tinctures, gummies, capsules, topicals) – Must be derived from hemp and have <0.3% Delta-9 THC.

  2. CBG, CBN, and Other Cannabinoids – As long as they follow federal THC limits.

  3. Delta-8 & Delta-10 THC – Legal under Georgia law as long as they are hemp-derived and contain <0.3% Delta-9 THC.

  4. Hemp-Derived THCa Flowers & Pre-Rolls – Legal as long as the THCa converts to <0.3% Delta-9 THC when tested under DEA protocols.

  5. Hemp-Infused Edibles & Beverages – Must comply with state labeling and testing regulations.

Restricted or Illegal Hemp Products

  • Marijuana-Derived Products – Only low-THC oil (medical cannabis) is allowed for registered patients.

  • High-THC Hemp Products – Anything exceeding 0.3% Delta-9 THC is considered illegal under Georgia law.

  • Smoking/Vaping in Public – While legal for personal use, smoking or vaping hemp products in public spaces may lead to legal issues.
